Important Legal Review Note
This document is a strong business and legal drafting foundation for Zyleme. It is designed to maximize operational clarity and liability protection while remaining understandable to customers. It should be reviewed and localized by qualified legal counsel in Ghana, the United States, and any other country in which Zyleme operates before publication or enforcement.
These Terms are written as a master agreement. Zyleme may also publish separate policies covering shipping, returns, wallet credits, privacy, acceptable use, merchant terms, and API/developer terms. Where any separate policy is incorporated by reference, it forms part of these Terms.

- 1. Introduction and Acceptance of Terms
These Terms and Conditions (the "Terms") govern your access to and use of the Zyleme website, mobile application, online platform, customer support channels, payment services, wallet credits, purchasing services, shipping coordination, delivery support, and any related services made available by Zyleme (collectively, the "Services"). By creating an account, placing an order, making a payment, depositing funds into a wallet, requesting a quote, using a Zyleme address, or otherwise using any Zyleme Service, you agree to be bound by these Terms.
If you are using Zyleme on behalf of a business, organization, church, school, company, or other entity, you represent that you have authority to bind that entity to these Terms. In that case, "you" and "Customer" refer to both you personally and the entity on whose behalf you use the Services.
Zyleme may update these Terms from time to time to reflect changes in law, operations, technology, shipping rules, customs procedures, risk controls, payment methods, new products, or business needs. Updated Terms become effective when posted on the Zyleme website or otherwise communicated through the platform, unless a later effective date is stated. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
If you do not agree to these Terms, you must stop using the Services. Your only remedy for disagreement with these Terms or future updates is to discontinue use of the Zyleme platform before placing further orders or making further wallet deposits.
2. Definitions
For clarity, the following definitions apply throughout these Terms unless the context requires otherwise. Defined terms may be used in singular or plural form.
"Zyleme," "we," "us," and "our" mean Zyleme and its owners, officers, directors, employees, contractors, agents, logistics partners, payment partners, service providers, and affiliates involved in providing the Services. "Customer," "Member," "user," "you," and "your" mean any person or entity using Zyleme.
"Seller" or "Merchant" means any third-party store, marketplace, brand, retailer, supplier, individual seller, platform seller, manufacturer, marketplace listing provider, or other third party from whom a product is purchased. Examples may include Amazon, eBay, Walmart, SHEIN, KHOI, Shopify stores, independent brand websites, or other online sellers.
"Order" means a request submitted through Zyleme for the purchase, shipment, delivery, or facilitation of one or more products or services. "Product" or "Goods" means any item purchased from a Seller or otherwise handled through the Services. "ETA" means estimated time of arrival or estimated delivery timeline and is always an estimate, not a guarantee.
"Wallet" or "Zyleme Balance" means prepaid credit held within the Zyleme platform for use toward eligible goods and services offered by Zyleme. Wallet credits are not bank deposits, e-money accounts, savings accounts, investment products, or withdrawable cash balances unless Zyleme expressly states otherwise and applicable law permits such treatment.
3. Eligibility and Account Registration
You must be legally capable of entering into a binding agreement in your jurisdiction to use Zyleme. If you are under the age of majority, you may use Zyleme only with the involvement and consent of a parent, guardian, or responsible adult who accepts these Terms on your behalf.
You agree to provide accurate, complete, current, and truthful information when registering, requesting quotes, making payments, providing delivery details, submitting identity documents, or communicating with Zyleme. This includes your full name, phone number, email address, delivery address, payment details, recipient details, tax or customs information where required, and any information reasonably needed to process your order.
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. You must notify Zyleme immediately if you suspect unauthorized access, fraud, password compromise, mistaken payment, or suspicious activity. Zyleme is not responsible for losses arising from your failure to keep your account secure or from your delay in reporting unauthorized activity.
Zyleme may refuse registration, suspend accounts, limit account functionality, require verification, or decline orders where information is inaccurate, incomplete, suspicious, inconsistent, or insufficient to satisfy Zyleme's risk, compliance, customs, payment, fraud, or operational requirements.
4. Zyleme's Role as Purchasing Agent and Logistics Facilitator
Unless expressly stated otherwise in writing, Zyleme acts as the Customer's purchasing agent, shopping facilitator, consolidation coordinator, shipping coordinator, delivery facilitator, and customer support intermediary. Zyleme is not the manufacturer, designer, brand owner, supplier, original seller, authorized dealer, distributor, or warrantor of third-party products purchased through or with the assistance of Zyleme.
When you place an order, you authorize Zyleme to purchase the selected product on your behalf from the Seller. Zyleme may use its own payment instruments, accounts, software, agents, addresses, warehouses, consolidation points, or logistics partners to complete the transaction, but the product remains a product supplied by the Seller, not by Zyleme as manufacturer or retailer.
Zyleme's core obligation is to use commercially reasonable efforts to facilitate the purchase, international movement, customs clearance coordination, and delivery of eligible goods according to the information provided by the Customer and the operational options available to Zyleme. Zyleme does not guarantee that any Seller will honor a listing, maintain stock, ship on time, accept returns, provide accurate descriptions, or supply defect-free goods.
Nothing in these Terms creates a partnership, joint venture, employment relationship, fiduciary relationship, franchise relationship, or agency relationship other than the limited purchasing and logistics facilitation agency expressly described in these Terms.
5. Customer Authorization to Purchase
By submitting an order and completing payment, you authorize Zyleme to purchase the selected product or products on your behalf, including paying the Seller, selecting reasonable shipping arrangements to Zyleme's facilities or partners, consolidating items where appropriate, arranging international shipment, coordinating customs clearance, and delivering or arranging delivery to the recipient address provided.
Zyleme may purchase items using a different account, payment method, billing address, or shipping address than the Customer would have used directly. This is part of the purchasing and logistics facilitation service. You agree that Zyleme may make reasonable operational decisions to process the order efficiently, reduce cost, manage risk, comply with Seller rules, or meet shipping requirements.
You acknowledge that orders may be subject to Seller terms, Seller cancellation policies, marketplace rules, fraud checks, return windows, listing limitations, seller ratings, delivery restrictions, export restrictions, or other conditions outside Zyleme's control. Zyleme is not liable for a Seller's refusal to accept, fulfill, cancel, delay, substitute, limit, or change an order.
If Zyleme cannot purchase an item because it is unavailable, restricted, incorrectly priced, suspicious, prohibited, no longer listed, incompatible with Zyleme's policies, or otherwise impractical to process, Zyleme may cancel the order and provide an appropriate refund or wallet credit according to the applicable refund provisions and the circumstances of the order.
6. Customer Responsibility for Product Selection
The Customer is solely responsible for confirming that the product selected is the exact item the Customer wants to purchase before submitting an order. This includes confirming the product link, seller, brand, model, size, color, material, dimensions, voltage, compatibility, quantity, condition, variant, accessories, warranty status, return eligibility, and any other relevant specification.
Zyleme may display product information, images, descriptions, prices, variants, and estimates obtained from third-party websites or provided by the Customer. Such information is for convenience only and may be incomplete, inaccurate, delayed, or changed by the Seller. The Customer must review and confirm the Seller's original listing and all relevant product details before payment.
Zyleme is not responsible for losses, dissatisfaction, returns, exchange costs, or disputes resulting from the Customer selecting the wrong product, wrong size, wrong color, wrong fit, wrong model, wrong variant, wrong voltage, wrong compatibility, wrong condition, wrong seller, wrong quantity, or wrong listing. Where the Customer requests Zyleme's assistance in locating a product, any recommendation is provided as shopping assistance only and does not remove the Customer's responsibility to confirm the final purchase decision.
Customers should be especially careful with clothing, shoes, electronics, automotive parts, machine parts, beauty products, medical-related items, jewelry, furniture, replacement parts, and products with regional specifications. Size charts, color displays, model numbers, plug types, voltage requirements, and compatibility data may vary by brand, seller, country, device, or manufacturer.
7. Pricing, Currency, Taxes, and Landed Cost Estimates
Zyleme may provide an all-inclusive checkout price that includes, where applicable, the item cost, international shipping, handling, customs clearance coordination, estimated duties, applicable taxes, payment processing costs, and delivery to the address provided. Unless otherwise stated at checkout, the price displayed at final payment is intended to cover the components listed for that order.
Because Zyleme purchases from third-party Sellers and operates across currencies and jurisdictions, prices may change before the order is completed. Seller prices, coupons, sales, taxes, local shipping charges, exchange rates, customs charges, dimensional weight, product weight, carrier surcharges, and availability can change at any time. If a material change occurs before Zyleme completes the purchase or shipment, Zyleme may request additional payment, offer a revised quote, cancel the order, provide a refund, or issue wallet credit where appropriate.
Zyleme may use estimated weight, dimensional weight, category assumptions, customs assumptions, shipping assumptions, and exchange-rate assumptions when calculating prices. If the actual product differs materially from the listing, if the Seller ships in multiple packages, if the product is heavier or larger than expected, if customs reclassifies the item, or if government charges change, Zyleme may reasonably adjust the order, request additional payment, or limit its service obligations.
Zyleme is not responsible for typographical errors, website errors, marketplace listing errors, obvious pricing errors, third-party data errors, scraping errors, currency conversion errors, or accidental quotations that are clearly inconsistent with the actual cost of the order. Zyleme reserves the right to correct such errors, cancel affected orders, or request corrected payment before proceeding.
8. Payments, Failed Payments, and Chargebacks
Zyleme may accept payment by card, mobile money, bank transfer, wallet balance, promotional credits, or other payment methods made available from time to time. Available payment methods may differ by country, customer type, order value, risk level, platform channel, or operational status.
You authorize Zyleme and its payment processors to charge your selected payment method for all amounts due, including order charges, wallet deposits, shipping charges, handling charges, customs-related charges, storage charges, return charges, rerouting charges, failed-delivery costs, payment processing charges, late charges, and other amounts authorized under these Terms or displayed at checkout.
Orders may not be processed until payment is confirmed, cleared, matched, verified, and accepted by Zyleme. Bank transfers, mobile money payments, and manual payments must include correct reference information where requested. Delays or errors in payment identification may delay order processing, and Zyleme is not liable for seller price changes or stock loss caused by delayed, incomplete, or incorrectly referenced payments.
Customers must not initiate false, fraudulent, abusive, or bad-faith chargebacks, reversals, payment disputes, or bank claims after receiving goods or after Zyleme has incurred purchase, shipping, customs, or service costs. If a Customer initiates an improper chargeback or payment reversal, the Customer remains liable for the amount owed, any bank fees, collection costs, legal fees, investigation costs, and any losses incurred by Zyleme. Zyleme may suspend the account, hold pending shipments, recover amounts from wallet balances, refuse future service, or pursue lawful remedies.
9. Wallet Credits and Zyleme Balance
Wallet credits, Zyleme Balance, gift balance, promotional balance, refund credits, and similar stored credits are provided for use on the Zyleme platform toward eligible goods and services. They are intended to simplify future purchases, order corrections, refunds, promotions, customer support resolutions, and loyalty benefits within the Zyleme ecosystem.
Except where required by applicable law or expressly agreed by Zyleme in writing, funds deposited into a wallet or credited to a Zyleme Balance are non-refundable, non-withdrawable, non-transferable, and not redeemable for cash, mobile money withdrawal, bank withdrawal, or external payment. Wallet balances may only be used to pay for eligible goods and services available through Zyleme.
Wallet credits are not deposit accounts, savings accounts, bank accounts, investment products, electronic money accounts, or regulated financial accounts unless expressly stated by Zyleme and approved under applicable law. Zyleme may place reasonable limits on wallet use, including limits related to fraud prevention, minimum order values, account verification, expiration of promotional credits, geographic availability, product eligibility, or regulatory compliance.
Zyleme may reverse wallet credits issued in error, credits obtained through fraud, credits tied to cancelled promotions, duplicate credits, chargeback-related credits, or credits arising from transactions later reversed or found to be invalid. If a Customer's account is suspended or terminated for fraud, illegal activity, chargeback abuse, prohibited goods, or serious violation of these Terms, wallet balances, rewards, or promotional credits may be frozen or forfeited to the extent permitted by law.
10. Promotions, Coupons, Referral Credits, and Loyalty Rewards
Zyleme may offer promotions, discount codes, referral credits, free-delivery offers, wallet bonuses, loyalty points, cashback-like rewards, influencer codes, seasonal campaigns, or special pricing from time to time. Such offers are discretionary, limited, non-transferable, and subject to the specific terms stated for the promotion.
Promotions may be modified, suspended, limited, revoked, corrected, or discontinued at any time without liability. Zyleme may refuse to honor a promotion where it is expired, misused, duplicated, combined improperly, applied to ineligible items, obtained through fraud, affected by a technical error, or inconsistent with the promotion's purpose.
Referral programs and loyalty rewards are intended for genuine customer acquisition and platform engagement. Customers may not create fake accounts, self-refer, manipulate devices, use bots, purchase from themselves, misrepresent identity, abuse coupon codes, or engage in any conduct designed to unfairly obtain rewards. Zyleme may reverse rewards, suspend accounts, cancel orders, or recover losses caused by promotional abuse.
Rewards, points, credits, or bonuses have no cash value unless expressly stated. Zyleme may set expiration dates, category restrictions, minimum spend requirements, maximum discount amounts, geographic limitations, or other conditions. Where a product is returned, cancelled, refunded, charged back, or disputed, associated rewards or promotional benefits may be reversed.
11. Product Availability, Seller Cancellations, and Listing Errors
Product availability is controlled by the Seller, not by Zyleme. A product may sell out, be removed, be restricted, be repriced, be cancelled by the Seller, be flagged by the marketplace, be limited by quantity, be refused due to shipping address, or become unavailable after the Customer places an order on Zyleme. Zyleme is not responsible for the Seller's decision or failure to fulfill.
Where an item becomes unavailable before purchase, Zyleme may cancel the order, request the Customer's approval for an alternative, issue a refund, issue wallet credit, or hold the payment pending Customer instruction for a reasonable period. Zyleme is not liable for lost deals, expired promotions, missed sales, price increases, or Customer disappointment caused by Seller availability changes.
Some third-party listings may contain obvious mistakes, such as incorrect prices, incorrect photos, inaccurate descriptions, wrong variants, miscategorized products, counterfeit claims, manipulated seller ratings, or misleading specifications. Zyleme may decline to purchase, cancel, hold, or investigate orders where the listing appears suspicious, risky, inconsistent, or likely to result in dispute.
If a Seller cancels after purchase or fails to ship, Zyleme will use commercially reasonable efforts to obtain a refund from the Seller or provide a reasonable resolution based on the actual funds recovered. Zyleme is not required to advance its own funds for Seller failures where the Seller has not refunded, except where Zyleme expressly accepts responsibility under these Terms.
12. Shipping, Delivery, and Estimated Timelines
Zyleme may arrange domestic shipping to a Zyleme facility, international shipping, consolidation, freight forwarding, customs clearance coordination, local delivery, and related logistics through its employees, contractors, affiliates, freight forwarders, couriers, airlines, bus partners, local delivery providers, and other independent service providers.
All ETAs, delivery timelines, arrival dates, shipping dates, clearance dates, and estimated delivery windows are estimates only. They are not guarantees, warranties, promises, or fixed deadlines. Orders may arrive earlier or later than estimated due to Seller dispatch time, split shipments, domestic carrier delays, airline schedules, cargo capacity, inspections, customs actions, weather, holidays, strikes, documentation issues, security checks, government actions, or other events beyond Zyleme's reasonable control.
A delay by itself does not entitle the Customer to cancel the order, reject the shipment, receive a refund, demand compensation, or claim breach of contract. Zyleme will use commercially reasonable efforts to provide updates where practical, but tracking updates may be delayed, incomplete, or unavailable depending on the carrier or stage of shipment.
Delivery to the Customer's address requires accurate recipient details, reachable phone numbers, safe access, reasonable availability, and cooperation by the Customer or recipient. Zyleme may use delivery partners and may share necessary recipient information with them to complete delivery. Delivery may be delayed or fail if the Customer provides incorrect information, cannot be reached, refuses delivery, changes address late, fails to pay an outstanding balance, or requests special handling not included in the original order.
13. Customs, Duties, Import Restrictions, and Government Actions
International shipments are subject to customs laws, import regulations, export controls, security inspections, documentation requirements, taxes, duties, valuation rules, product classification rules, and government decisions in origin, transit, and destination countries. Customs authorities may inspect, open, delay, reclassify, assess, seize, reject, destroy, return, fine, or impose conditions on shipments.
Zyleme may estimate customs duties, taxes, and clearance costs based on information available at the time of quote. However, final customs treatment is determined by government authorities and may differ from estimates. Customs may require additional documentation, proof of purchase, product descriptions, licenses, tax identification information, recipient information, or other details from the Customer.
The Customer is responsible for ensuring that goods ordered are lawful to import into the destination country and lawful to export from the seller's country. The Customer must not order prohibited, restricted, controlled, sanctioned, counterfeit, dangerous, or illegal items. If customs or another authority delays, seizes, confiscates, destroys, rejects, fines, or imposes penalties on a shipment due to the nature of the goods, inaccurate information, false valuation, missing documents, recipient ineligibility, or Customer conduct, Zyleme is not liable for the resulting loss.
Where Zyleme pays duties, taxes, penalties, storage, demurrage, inspection fees, return costs, disposal costs, fines, or other customs-related charges because of the Customer's order or information, the Customer agrees to reimburse Zyleme unless such charges were caused solely by Zyleme's gross negligence or willful misconduct.
14. Prohibited and Restricted Items
Customers may not use Zyleme to purchase, ship, receive, store, consolidate, export, import, deliver, finance, or facilitate illegal, prohibited, restricted, hazardous, dangerous, counterfeit, stolen, regulated, sanctioned, or export-controlled items. The prohibited list in Schedule A is not exhaustive. Zyleme may update, interpret, expand, or apply the list based on law, carrier rules, customs practice, risk, destination country, or business policy.
Zyleme may refuse, cancel, hold, inspect, return, discard, report, surrender to authorities, or otherwise deal with prohibited or restricted items without liability. If a prohibited or restricted item arrives at a Zyleme facility or partner facility, the Customer remains responsible for return costs, storage costs, disposal costs, penalties, fines, administrative costs, legal costs, and any losses resulting from the attempted shipment.
Zyleme is not required to provide refunds for prohibited or restricted items where Zyleme has already incurred purchase costs, shipping costs, customs costs, carrier charges, seller non-refundable charges, or other expenses, or where the item is seized, destroyed, forfeited, or refused by authorities or carriers. Where a Seller accepts return and refunds Zyleme, Zyleme may pass through the recovered amount less applicable costs.
If you are unsure whether an item is prohibited or restricted, you must contact Zyleme before placing the order. Zyleme's response is based on information available at the time and does not override government authority, carrier rules, or subsequent changes in law.
15. Product Quality, Defects, Size, Color, Fit, and Seller Issues
Products purchased through Zyleme are supplied by third-party Sellers. Zyleme does not manufacture, design, test, certify, inspect for performance, warrant, or guarantee third-party products unless Zyleme expressly provides a separate written guarantee for a specific service or product category.
Zyleme is not responsible for damaged goods caused by the Seller before receipt by Zyleme, manufacturer defects, faulty parts, wrong fit, wrong sizing, color differences, inaccurate seller descriptions, missing accessories, used items sold as new, counterfeit claims, product recalls, performance failures, warranty issues, compatibility problems, or dissatisfaction with product quality, appearance, material, authenticity, packaging, or function.
The Customer must confirm product suitability before ordering. For fashion items, this includes size charts, measurements, fit style, color choice, material, return eligibility, and brand-specific sizing. For electronics, parts, equipment, and accessories, this includes model number, voltage, region, serial compatibility, plug type, software compatibility, warranty region, and installation requirements.
If an issue appears to originate from the Seller or manufacturer, Zyleme may, as a courtesy and where operationally feasible, assist the Customer in communicating with the Seller or pursuing a Seller return. However, Zyleme is not required to guarantee a Seller response, Seller refund, Seller exchange, manufacturer warranty, international return eligibility, or reimbursement of shipping and customs costs unless Zyleme separately caused the issue during shipping or handling under its control.
16. Cancellations, Returns, Refunds, and Exchanges
Cancellation requests must be submitted as soon as possible. Once Zyleme has purchased an item from the Seller, cancellation may be unavailable or subject to Seller cancellation policies, Seller return windows, restocking fees, non-refundable charges, domestic return shipping, international return shipping, customs costs, and Zyleme service costs.
Returns, refunds, and exchanges are primarily governed by the Seller's policy. If the Seller does not accept returns, if the return window has expired, if the item is final sale, if the product is used, damaged, missing packaging, ineligible for international return, customized, perishable, hygiene-related, restricted, or otherwise non-returnable, Zyleme may be unable to facilitate a return or refund.
Shipping charges, handling fees, customs duties, taxes, payment processing fees, clearance charges, delivery fees, storage fees, return shipping, and Zyleme service fees are generally non-refundable unless the refund is due solely to an error by Zyleme. If Zyleme obtains a refund from a Seller, Zyleme may deduct non-recoverable costs before refunding or crediting the Customer.
Refunds may be issued to the original payment method, wallet balance, gift balance, or another method chosen by Zyleme based on payment method, operational feasibility, fraud risk, chargeback risk, refund reason, and applicable law. Refund timelines depend on payment processors, banks, mobile money providers, Seller refund timelines, and Zyleme's internal review.
17. Shipping Claims, Lost Shipments, Damage, and Insurance
Zyleme's responsibility for shipping loss or damage is limited to goods while they are under Zyleme's control or under the control of logistics partners appointed by Zyleme, subject to the limitations in these Terms. Zyleme is not responsible for damage, loss, defects, missing parts, or inaccurate goods caused before delivery to Zyleme or caused by the Seller, manufacturer, domestic carrier to Zyleme, marketplace fulfillment center, or Customer-provided shipping arrangement.
Claims must be submitted promptly after delivery or after Zyleme notifies the Customer of a shipping issue. The Customer must provide photographs, videos, packaging images, proof of purchase, order details, delivery receipt, serial numbers where applicable, and any other evidence reasonably requested. Failure to provide timely and complete evidence may invalidate or reduce a claim.
Insurance, where available, is subject to carrier terms, commodity limitations, declared value limits, documentation requirements, exclusions, deductibles, and investigation timelines. Certain items, including electronics, jewelry, fragile items, glass, furniture, lighting, collectible items, used goods, high-value goods, and items shipped in manufacturer packaging, may have lower liability limits or may be excluded by carriers.
Any claim payment is limited to the lesser of the actual amount paid for the affected item, the declared value, the applicable carrier recovery, the insurance recovery, the commodity liability limit, or the liability cap stated in these Terms. Zyleme is not liable for indirect damages, sentimental value, lost data, lost profits, business interruption, special events, replacement urgency, or consequential losses related to lost or damaged shipments.
18. Unclaimed, Abandoned, Undeliverable, or Refused Shipments
Customers must remain reachable after placing an order and must cooperate with delivery. This includes answering calls, responding to messages, confirming address details, paying outstanding balances, providing recipient information, making reasonable arrangements to receive the shipment, and notifying Zyleme promptly if contact details change.
If goods arrive in the destination country and the Customer or recipient cannot be reached, refuses delivery, repeatedly misses delivery attempts, provides an incorrect address, fails to pay required outstanding charges, fails to provide necessary information, or otherwise prevents delivery, Zyleme may hold the shipment for a reasonable period and make reasonable attempts to contact the Customer using the contact details on file.
If a shipment remains unclaimed, undeliverable, unpaid, or uncollected for forty (40) consecutive days after arrival or after reasonable notification attempts, Zyleme may, to the extent permitted by law, charge storage fees, return the shipment where feasible, reroute the shipment at the Customer's cost, dispose of the goods, donate the goods, sell the goods to recover outstanding costs, or otherwise deal with the shipment in a commercially reasonable manner.
Zyleme shall not be liable for loss, depreciation, damage, storage costs, disposal, return costs, missed use, or other consequences arising from the Customer's failure to receive, collect, communicate about, pay for, or provide correct information for a shipment within the stated period.
19. User Conduct and Acceptable Use
Customers must use Zyleme lawfully, respectfully, and only for legitimate shopping, purchasing, shipping, delivery, and related commerce purposes. You may not use the platform to violate laws, infringe rights, harass people, threaten staff, defame others, distribute malware, conduct scams, launder money, evade sanctions, ship prohibited items, abuse promotions, create fake accounts, scrape the platform, reverse engineer software, or interfere with Zyleme's operations.
You may not upload, post, send, publish, distribute, or transmit unlawful, defamatory, obscene, abusive, offensive, inflammatory, fraudulent, misleading, infringing, private, harmful, or malicious content. You may not submit another person's personal information without authorization or use Zyleme to impersonate any person, business, government body, brand, influencer, merchant, or employee.
You may not use bots, spiders, automated scraping, data mining, credential stuffing, denial-of-service attacks, security probing, unauthorized APIs, or other technical methods to access, monitor, copy, disrupt, overload, or exploit the platform without written permission. You may not attempt to bypass security, fraud controls, payment controls, geographic restrictions, wallet restrictions, order limits, or promotional rules.
Zyleme may investigate suspected violations and may remove content, cancel orders, refuse service, limit functionality, suspend accounts, report conduct to authorities, hold shipments, preserve evidence, or take other lawful measures to protect customers, partners, staff, the platform, and the business.
20. Fraud Prevention, Verification, and Security
Zyleme may use commercially reasonable fraud prevention, identity verification, transaction monitoring, risk scoring, device checks, payment checks, account reviews, address reviews, order reviews, document reviews, and manual investigations to protect the platform and comply with law. These measures may delay or prevent order processing.
Zyleme may request identity documents, proof of address, proof of payment, card authorization evidence, mobile money confirmation, bank transfer confirmation, recipient verification, customs information, product-use information, business registration documents, tax identification, or other information reasonably needed to verify a transaction or customer. Failure to provide requested information may result in cancellation, shipment hold, refund delay, wallet restriction, or account suspension.
Zyleme is not liable for delays caused by fraud checks, verification processes, payment reviews, compliance reviews, customs reviews, or security procedures. If a transaction is suspected to involve fraud, stolen payment instruments, false identity, chargeback abuse, prohibited goods, sanctions risk, or illegal activity, Zyleme may refuse to process the order or may hold the order pending investigation.
Customers are responsible for promptly reporting suspected unauthorized account access, mistaken payments, fraudulent orders, phishing attempts, suspicious messages, or changes in account credentials. Zyleme will use reasonable efforts to assist, but it is not liable for losses caused by Customer negligence, compromised devices, shared passwords, phishing, social engineering, or delay in reporting.
21. Communications, Electronic Acceptance, and Notices
You consent to receive communications from Zyleme electronically, including through email, SMS, WhatsApp, phone calls, push notifications, in-app messages, website notices, receipts, invoices, account alerts, order updates, delivery updates, policy updates, security notices, marketing messages, and customer support communications. Transactional and security communications may be sent even if you opt out of marketing messages.
By clicking "I agree," creating an account, submitting an order, making a payment, depositing wallet funds, using a Zyleme address, responding to a quote, or otherwise using the Services, you electronically accept these Terms. Electronic acceptance has the same legal effect as a physical signature to the fullest extent permitted by law.
Notices to Zyleme must be sent through official support channels listed on the platform or by email to support@zyleme.com unless Zyleme designates another address. Notices from Zyleme may be sent to the email address, phone number, WhatsApp number, account dashboard, or address associated with your account. You are responsible for keeping contact information accurate.
Marketing communications may include offers, reminders, abandoned-cart messages, promotions, surveys, product updates, loyalty information, partnership campaigns, and platform announcements. You may opt out of promotional messages using available opt-out methods, but opting out does not affect Zyleme's ability to send order-related, legal, or security messages.
22. Intellectual Property and Platform Content
All Zyleme names, logos, trademarks, service marks, trade names, slogans, graphics, user interfaces, designs, software, code, data structures, workflows, algorithms, pricing systems, product displays, content, images, text, documents, platform architecture, and other intellectual property are owned by or licensed to Zyleme and are protected by applicable intellectual property laws.
You may use the platform only for personal or authorized business use in accordance with these Terms. You may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, scrape, mirror, frame, create derivative works from, or commercially exploit Zyleme's platform, software, content, data, or brand without prior written permission.
Product images, descriptions, brand names, merchant names, and third-party content displayed through Zyleme may belong to the relevant Seller, brand, marketplace, or rights holder. Their appearance on Zyleme does not imply endorsement, sponsorship, partnership, or authorization unless expressly stated.
If you submit reviews, feedback, suggestions, images, testimonials, comments, product requests, support messages, or other content to Zyleme, you grant Zyleme a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, display, distribute, and create derivative works from that content for business, marketing, support, analytics, product improvement, and platform operation purposes, subject to Zyleme's Privacy Policy and applicable law.
23. Privacy and Data Use
Zyleme collects and uses information as described in its Privacy Policy. Information may include account details, contact information, order history, payment references, delivery addresses, recipient information, device information, communications, support records, browsing activity, product preferences, wallet activity, and other information necessary to provide and improve the Services.
Zyleme may share information with payment processors, shipping partners, customs brokers, delivery providers, customer support tools, analytics providers, fraud prevention services, marketing tools, technology vendors, legal advisors, government authorities, or other service providers where reasonably necessary to operate the platform, process orders, comply with law, prevent fraud, resolve disputes, or protect the business.
Zyleme may use aggregated, anonymized, pseudonymized, or de-identified data to understand product demand, improve pricing, optimize shipping, forecast delivery, build business intelligence products, improve customer experience, support merchants, and develop new services. Such data does not identify individual customers where properly anonymized or aggregated.
Customers should not submit unnecessary sensitive information through public channels or unsecured messages. Zyleme will use commercially reasonable efforts to protect personal information, but no system is completely secure. Customers are responsible for using secure devices, protecting passwords, and avoiding phishing or fraudulent communications.
24. Account Suspension, Termination, and Refusal of Service
Zyleme may suspend, restrict, terminate, or refuse service to any account or Customer at any time where Zyleme reasonably believes the Customer has violated these Terms, engaged in fraud, abused staff, misused promotions, initiated improper chargebacks, ordered prohibited goods, provided false information, failed verification, created operational risk, violated law, or created risk to Zyleme, its partners, other customers, or the public.
Suspension or termination may affect pending orders, wallet access, delivery options, promotions, rewards, support access, marketplace access, merchant services, API access, or other platform features. Zyleme may hold shipments, require payment of outstanding charges, require identity verification, cancel pending orders, return goods where feasible, or take other reasonable steps to protect its interests.
If an account is terminated for convenience and there is no fraud, illegal activity, chargeback abuse, prohibited goods issue, or outstanding liability, Zyleme may allow the Customer to use eligible wallet balance or may provide another resolution as required by applicable law and Zyleme policy. If the account is terminated for serious violation, Zyleme may freeze or forfeit promotional credits, rewards, bonuses, or credits obtained through improper conduct to the extent permitted by law.
Zyleme's decision not to enforce a provision immediately does not waive its right to enforce that provision later. Zyleme may choose commercially reasonable remedies based on the nature of the violation, risk, customer history, amount involved, and operational impact.
25. Limitation of Liability
To the fullest extent permitted by applicable law, Zyleme's total liability for any claim arising out of or related to an order, shipment, wallet transaction, account, product, delivery, delay, platform use, or these Terms shall not exceed the amount actually paid by the Customer to Zyleme for the affected order or transaction giving rise to the claim.
Zyleme shall not be liable for indirect, incidental, special, consequential, exemplary, punitive, or remote damages, including loss of profits, lost business, lost opportunity, loss of goodwill, emotional distress, inconvenience, lost data, lost use, reputational harm, business interruption, missed events, missed deadlines, replacement urgency, or losses arising from reliance on estimated delivery dates.
Zyleme is not liable for Seller actions or omissions, manufacturer defects, inaccurate listings, counterfeit claims, wrong product supplied by the Seller, delayed seller dispatch, Seller cancellations, Seller refusal to refund, payment processor delays, bank delays, mobile money network issues, customs actions, government restrictions, carrier delays, force majeure events, Customer-provided incorrect information, or prohibited goods consequences except to the limited extent caused directly by Zyleme's gross negligence or willful misconduct.
Some jurisdictions do not allow certain exclusions or limitations of liability. In such jurisdictions, Zyleme's liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes liability that cannot legally be excluded, such as liability for fraud by Zyleme or other non-excludable obligations under applicable consumer protection law.
26. Indemnification
You agree to indemnify, defend, and hold harmless Zyleme, its shareholders, officers, directors, employees, contractors, agents, logistics partners, payment partners, affiliates, and service providers from and against any claims, actions, damages, losses, liabilities, penalties, fines, judgments, settlements, costs, and expenses, including reasonable attorneys' fees and court costs, arising out of or related to your use of the Services.
This indemnity includes claims arising from inaccurate information supplied by you, prohibited or restricted goods, false valuation, customs violations, export violations, import violations, intellectual property infringement, fraud, chargeback abuse, failure to pay amounts owed, misuse of the platform, violation of these Terms, violation of law, negligent or wrongful conduct, unauthorized use of another person's information, and any claim by a recipient, business partner, Seller, payment provider, carrier, government authority, or third party caused by your order or conduct.
You also agree to indemnify Zyleme for costs arising from Zyleme's preparation, correction, execution, or submission of shipping documents, customs information, delivery information, classification information, value information, recipient information, or routing information based on information provided by you, except where the claim arises solely from Zyleme's gross negligence or willful misconduct.
The indemnification obligations in this section survive completion of an order, delivery of goods, refund of any amount, termination of your account, discontinuation of the Services, and termination or expiration of these Terms.
27. Force Majeure
Zyleme shall not be liable for delay, non-performance, partial performance, failure to deliver, failure to process, increased cost, data interruption, communication failure, or other failure caused by events beyond its reasonable control. Such events include natural disasters, storms, floods, fires, earthquakes, pandemics, epidemics, public health emergencies, wars, terrorism, civil unrest, strikes, labor disputes, port closures, airline disruptions, fuel shortages, government shutdowns, customs backlogs, border closures, sanctions, embargoes, changes in law, cyberattacks, power outages, internet outages, payment network failures, supplier failures, carrier failures, and other events beyond reasonable control.
During a force majeure event, Zyleme's obligations are suspended to the extent affected by the event. Zyleme will use commercially reasonable efforts to resume performance when practical, but Zyleme is not required to incur unreasonable costs, violate law, use unsafe routes, advance funds, guarantee delivery, or provide compensation for delays caused by such events.
Customers acknowledge that cross-border commerce is inherently exposed to international logistics risk. Delays, inspections, government actions, and carrier disruptions may occur even where Zyleme has acted reasonably. ETAs may be revised repeatedly during a force majeure event or other logistics disruption.
28. Dispute Resolution and Governing Law
Customers are encouraged to contact Zyleme Customer Support first regarding any concern, complaint, claim, refund issue, delivery issue, wallet issue, or account issue. Zyleme will attempt to resolve disputes in good faith through internal review, documentation, order records, carrier records, Seller records, payment records, and reasonable communication with the Customer.
Before filing any formal claim, the Customer agrees to provide Zyleme written notice describing the dispute, the order number, the relief requested, the supporting evidence, and the Customer's contact information. The parties should attempt good-faith negotiation for at least thirty (30) days after Zyleme receives the notice unless applicable law requires a different process.
These Terms shall be governed by the laws applicable to Zyleme's principal place of business, unless mandatory consumer protection, data protection, payment, shipping, or other applicable law requires otherwise. Zyleme should insert its chosen governing law and dispute venue after legal review.
To the fullest extent permitted by law, disputes should be resolved individually and not as part of a class, collective, consolidated, representative, or group proceeding. If any class-action waiver, arbitration requirement, venue clause, or dispute-resolution provision is unenforceable in a jurisdiction, it shall be modified or severed to the minimum extent necessary while preserving the remaining provisions.
29. General Legal Provisions
These Terms, together with any policies incorporated by reference, constitute the entire agreement between the Customer and Zyleme regarding the Services and supersede prior or contemporaneous communications, understandings, proposals, representations, or agreements relating to the same subject matter.
If any provision of these Terms is found invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or severed if modification is not possible. The remaining provisions remain in full force and effect.
Zyleme's failure to enforce any provision of these Terms does not waive its right to enforce that provision later. Any waiver must be in writing and signed by an authorized representative of Zyleme. Headings are for convenience only and do not affect interpretation.
The Customer may not assign or transfer rights or obligations under these Terms without Zyleme's prior written consent. Zyleme may assign, transfer, subcontract, delegate, or novate its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, affiliate arrangement, financing, operational partnership, or service provider arrangement.
Sections that by their nature should survive termination shall survive, including payment obligations, wallet restrictions, prohibited goods obligations, customs responsibilities, limitation of liability, indemnification, intellectual property, dispute resolution, governing law, and general provisions.
Schedule A. Prohibited and Restricted Items
The following list is non-exhaustive. Zyleme may refuse, cancel, return, discard, surrender, or report any item that is prohibited, restricted, hazardous, controlled, suspicious, impractical, or inconsistent with law, carrier rules, customs rules, or Zyleme policy.

Firearms, firearm parts, gun accessories, replicas, magazines, tactical equipment, ammunition, knives, swords, stun devices, restraints, scopes, night-vision devices, and similar weapons or law-enforcement equipment.

Perishable foods, refrigerated goods, frozen goods, fresh fruits, fresh vegetables, live animals, plants, seeds, agricultural goods, biological materials, and products requiring quarantine or special inspection.
Cash, currency, money orders, cashier's checks, bearer instruments, precious metals, high-value negotiable instruments, collectible stamps, gambling devices, lottery tickets, and similar items.
Pornographic, obscene, counterfeit, stolen, pirated, infringing, fake-brand, or unauthorized replica goods.
Government identification documents, badges, uniforms, official-looking documents, lock-picking devices, surveillance equipment, or items intended for unlawful impersonation, unauthorized access, or privacy invasion.
Products subject to sanctions, embargoes, ITAR, EAR export controls, OFAC restrictions, customs restrictions, import licensing, or destination-country restrictions.
Any item that carriers, customs authorities, airlines, freight forwarders, payment partners, or Zyleme determine cannot be safely or lawfully processed.
Schedule B. Shipping Claim Requirements
To submit a claim for shipping-related damage or loss, the Customer must provide complete and timely supporting documentation. Zyleme may reject incomplete, late, inconsistent, or unsupported claims.
Order number and Customer account details.
Clear photos and videos of the item, all sides of the packaging, shipping labels, and visible damage.
Proof of purchase, invoice, receipt, declared value, and product listing where available.
Delivery date, recipient name, delivery address, and description of the issue.
Serial numbers, model numbers, IMEI numbers, or unique identifiers for electronics and high-value goods where applicable.
Written statement confirming whether the packaging was damaged upon receipt and whether the item was used after delivery.
Any additional documentation requested by Zyleme, carrier, insurer, customs broker, or delivery partner.
Claims are reviewed individually and may require carrier investigation, seller investigation, insurance review, customs review, delivery partner review, and internal Zyleme review. Review timelines may be extended where third parties delay providing information.
Schedule C. Quick Customer Summary
This summary is provided for customer convenience only. If there is any conflict between this summary and the full Terms, the full Terms control.
Zyleme helps you buy items from global online stores and deliver them to your address.
Zyleme purchases the item on your behalf after you pay.
You must confirm the product, size, color, model, quantity, and compatibility before ordering.
Wallet funds are for purchases on Zyleme only and are generally not refundable or withdrawable.
Delivery dates are estimates and may be faster or slower due to international logistics and customs.
Zyleme is responsible only for shipping-related issues within its control, not seller defects, wrong fit, wrong size, wrong color, or faulty products supplied by third-party sellers.
If your goods arrive and you cannot be reached or fail to receive them for 40 days, Zyleme may charge storage fees or dispose of the shipment according to the Terms.
If a shipment is delayed more than six months beyond the ETA, Zyleme will investigate and determine an appropriate resolution based on the records and circumstances.
Do not order prohibited, illegal, hazardous, or restricted items.
Your maximum claim against Zyleme is generally limited to the amount paid for the affected order, subject to applicable law.
Schedule D. Warehouse Address, Consolidation, and Export Agency Terms
Where Zyleme provides a U.S., international, or local address, suite number, warehouse reference, or receiving identifier, that address is provided only for Zyleme-supported purchasing, receiving, consolidation, export, import, and delivery services. The Customer must not represent that any Zyleme address is the Customer's residence, place of business, registered office, mailing address, tax address, banking address, or legal address unless Zyleme expressly agrees in writing.
Packages received at Zyleme facilities or partner facilities may be opened, inspected, photographed, measured, weighed, repacked, consolidated, relabeled, returned, discarded, or held where reasonably necessary for identification, export preparation, customs compliance, fraud prevention, safety, carrier acceptance, payment verification, or operational processing. Customers acknowledge that carriers, freight forwarders, customs authorities, warehouse providers, and delivery partners may also open or inspect shipments.
If a package arrives with an incomplete, incorrect, old, missing, or unidentifiable address, suite number, customer reference, order number, or recipient information, Zyleme may attempt to identify the Customer but is not responsible for delays, storage fees, return fees, misrouting, loss, or disposal caused by missing or inaccurate labeling. Zyleme may charge reasonable fees for manual identification, correction, relabeling, storage, or special handling.
Where Zyleme consolidates multiple packages for export or delivery, consolidation is performed to improve efficiency and may require repacking, removal of unnecessary outer packaging, grouping of shipments, or adjustment of shipping methods. Consolidation does not create any obligation for Zyleme to inspect product quality, test functionality, verify authenticity, confirm sizing, verify compatibility, or guarantee that Seller-supplied items match the Customer's expectations.
Customers remain responsible for ensuring that goods sent to Zyleme are lawful to export, lawful to import, accurately described, properly valued, and not prohibited or restricted. Title, risk, and legal responsibility for goods supplied by third-party Sellers remain subject to the Seller's terms and applicable law, except for the limited shipping responsibility Zyleme expressly accepts under these Terms.
